1. Agreement to Terms
Welcome to True To Blue. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and True To Blue ("Company," "we," "us," or "our") governing your access to and use of our website, mobile applications, and services (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age
- Have the legal authority to enter into a binding agreement
- Not be prohibited from using the Services under applicable laws
- Have authority to bind any business entity on whose behalf you use the Services
If you are using the Services on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms.
3. Description of Services
True To Blue provides smart voice assistant solutions and business management tools designed for trade professionals. Our Services may include:
- AI-powered voice assistant for call handling
- Intelligent call routing and management
- Lead capture and management systems
- Appointment scheduling tools
- Quote generation capabilities
- Customer relationship management features
- Business analytics and reporting
- SMS/text messaging services
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.
4. Account Registration and Security
To access certain features of our Services, you may be required to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password confidential and secure
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that contain inaccurate or incomplete information, or for any violation of these Terms.
5. Payment Terms
5.1 Fees and Billing
Certain Services require payment of fees. By subscribing to a paid plan, you agree to pay all applicable fees as described on our pricing page. Fees are:
- Billed in advance on a monthly or annual basis
- Non-refundable except as expressly stated in these Terms
- Subject to change with 30 days' notice
5.2 Payment Methods
We accept major credit cards and other payment methods as indicated. You authorize us to charge your selected payment method for all fees due. If payment fails, we may suspend your access to the Services.
5.3 Free Trials
We may offer free trial periods. At the end of a trial period, your paid subscription will begin unless you cancel before the trial expires. You are responsible for canceling if you do not wish to continue with a paid subscription.
5.4 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will be effective at the end of your current billing period. No refunds will be provided for partial billing periods.
6. Acceptable Use Policy
You agree not to use the Services to:
- Violate any applicable laws, regulations, or third-party rights
- Send spam, unsolicited messages, or engage in illegal telemarketing
- Transmit malware, viruses, or harmful code
- Interfere with or disrupt the Services or servers
- Attempt to gain unauthorized access to any systems or data
- Use the Services for fraudulent or deceptive purposes
- Harass, threaten, or defame others
- Collect personal information without proper consent
- Resell or redistribute the Services without authorization
- Violate telephone consumer protection laws (TCPA, DNC regulations)
Violation of this policy may result in immediate termination of your account and legal action.
7. SMS/Text Messaging Terms
By opting in to receive SMS messages from True To Blue, you agree to the following:
- You consent to receive recurring automated text messages at the phone number provided
- Message frequency varies based on account activity
- Message and data rates may apply
- Consent is not a condition of purchase
- You can opt out at any time by replying STOP
- Reply HELP for assistance
We are not responsible for messages that are delayed or undelivered due to carrier issues. Supported carriers include major US carriers, but coverage may vary.
8. Intellectual Property Rights
8.1 Our Intellectual Property
The Services, including all content, features, and functionality (text, graphics, logos, icons, images, audio, software, and code), are owned by True To Blue and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our written consent.
8.2 Your Content
You retain ownership of content you upload or create through the Services ("Your Content"). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display Your Content solely for the purpose of providing the Services.
8.3 Feedback
If you provide feedback, suggestions, or ideas about the Services, you grant us the right to use such feedback without restriction or compensation to you.
9. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our data practices as described in the Privacy Policy.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or secure. We are not responsible for any delays, delivery failures, or other damage resulting from the transfer of data over communications networks, including the Internet.
While our voice assistant is designed to handle calls professionally, we do not guarantee that all calls will be handled to your satisfaction. You remain responsible for following up on leads and managing your business relationships.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUE TO BLUE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless True To Blue and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your Content uploaded to the Services
- Your violation of applicable laws, including telemarketing regulations
13. Term and Termination
These Terms remain in effect until terminated. You may terminate by discontinuing use of the Services and closing your account. We may terminate or suspend your access at any time, with or without cause, and with or without notice.
Upon termination:
- Your right to use the Services will cease immediately
- We may delete your account and data (subject to legal retention requirements)
- Provisions that should survive termination will remain in effect
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at legal@truetoblue.com to attempt to resolve the dispute informally within 30 days.
14.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute arising from these Terms shall be resolved by binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall be conducted in the English language and the arbitrator's decision shall be final and binding.
14.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Texas.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after any changes constitutes acceptance of the new Terms.
17. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and True To Blue regarding the Services.
- Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
- Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
- Assignment: You may not assign these Terms without our consent. We may assign our rights without restriction.
- Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control.
